California NEMT insurance requirements

California NEMT operators are regulated by the CPUC as charter-party carriers (TCP permit) and, for Medi-Cal transportation, by DHCS-contracted brokers (Modivcare, MTM, Access2Care). Commercial auto CSL scales by vehicle seating up to $5M, and workers' comp is mandatory day one via WCIRB for every driver — no 1099 exemption for livery.

Texas NEMT insurance requirements

Texas is a workers' comp non-subscriber state, but nearly every broker requires coverage anyway.

  • Illinois — HFS Medicaid transportation commonly requires $1.5M–$2M CSL
  • Massachusetts — MassHealth PT-1 program requires $1.5M CSL on many routes
  • Washington — HCA-contracted brokers push $1.5M CSL on stretcher work

Broker overlays that trump the state floor

Even in states with lower statutory minimums, the actual insurance floor is set by the Medicaid broker's Independent Transportation Provider agreement. If Modivcare, MTM, Access2Care, or Verida requires a higher limit than the state, the broker limit wins.
